• The state capital of Erfurt (hereinafter referred to as the “Concession Grantor”) is implementing its currently largest urban development project. By 2028, numerous construction measures are intended to make the southeastern part of Erfurt more livable: social facilities, sports and recreational areas, green spaces, streets, and pathways will be modernized in a future-oriented manner. In particular, as a pilot project, uniform mobility stations—clearly identifiable through information points—will be established in several locations throughout the public realm. Within the framework of this pilot project, the Concession Grantor plans to award concession contracts for the construction and operation of charging infrastructure (Lot 1) as well as for the establishment and operation of a car-sharing service (Lot 2). To this end, the Concession Grantor has submitted a funding application under the “Model Project for the Further Development of Urban Development Funding” program and has received preliminary approval for the corresponding funding amount. Additionally, the Concession Grantor has submitted a funding application for a grant from the Free State of Thuringia, drawn from the Thuringian State Budget, Individual Plan 10, Chapter 1004, Item 8834, to finance an infrastructure project entitled “Model Project for the Further Development of Urban Development Funding – Erfurt Southeast,” specifically Action Area/Project 6 “Mobility Stations,” and has likewise obtained preliminary approval for the requested funding amount. The conclusion of the contracts (see Annex 4 to the Scope of Services and subsequent Clause 3 e) hh)) is subject to the condition that the relevant funding—also in its final approved amount—is actually granted and that the Concession Grantor’s corresponding co‑financing contribution is duly allocated in accordance with budgetary regulations.
