What is the Federal Audit Office?
The Federal Audit Office is an independent constitutional body of the Federal Republic of Germany, headquartered in Bonn with a branch office in Frankfurt am Main, which audits the entire budget and financial management of the Federation. Its constitutional basis is set out in Article 114(2) of the Basic Law, and its organisation is regulated by the Federal Audit Office Act (BRHG). The members of the Federal Audit Office enjoy judicial independence and are not bound by instructions.
The Federal Audit Office audits all federal authorities, federal enterprises, federal companies and entities that use federal funds. In procurement, this means that all federal tender procedures – from small sub-threshold contracts to major projects – may fall within the Federal Audit Office's audit competence.
Role in procurement oversight
The Federal Audit Office is not a legal protection mechanism for bidders, but an instrument of parliamentary financial control. It audits procurement procedures from the perspective of the proper and economic use of funds, not with the aim of protecting bidder rights. In this respect, it differs fundamentally from the public procurement tribunals and procurement senates, which provide individual legal protection for bidders.
Typical audit subjects in the procurement area:
- Compliance with the tendering obligations under Section 55 BHO
- Economic efficiency of the procurement procedure chosen
- Appropriateness of the prices agreed
- Completeness and accuracy of procurement documentation
- Compliance with deadlines and formal requirements
Types of audits
The Federal Audit Office conducts both ex post audits and accompanying advisory activities (advisory function).
Annual audit report
Each year, the Federal Audit Office issues an audit report (Bemerkungen) to the German Bundestag and the Bundesrat. Identified shortcomings – including in procurement practice – are presented publicly therein.
Cross-cutting audits
In addition to case-by-case audits, the Federal Audit Office conducts thematic cross-cutting audits in which procurement practices in several authorities are systematically analysed.
Advisory function
On request or ex officio, the Federal Audit Office may issue recommendations and guidance for improving procurement practice.
Sanctioning powers and effect
The Federal Audit Office has no direct sanctioning powers: it cannot declare contracts void, impose fines or directly discipline civil servants. Its oversight effect unfolds through:
- Public impact of its observations (political pressure)
- Reporting to the Bundestag (parliamentary control)
- Duty of the audited bodies to act on findings within their own responsibility
Distinction from other oversight bodies
| Institution | Function | Legal protection for bidders? |
|---|---|---|
| Federal Audit Office | Budgetary oversight (ex post) | No |
| Public procurement tribunal | Review during the procedure | Yes |
| Procurement senate (OLG) | Appeal against the tribunal | Yes |
| Ordinary courts | Damages | Yes |
FAQ
Can a bidder turn to the Federal Audit Office if they feel disadvantaged? No. The Federal Audit Office is not a complaints body for bidders. Legal protection against award decisions must be sought exclusively through the public procurement tribunals (above the EU thresholds) or the competent courts.
How does an objection by the Federal Audit Office affect a current contract? In principle, not directly. The Federal Audit Office may issue recommendations but does not have the power to cancel contracts that have already been concluded.
Does the Federal Audit Office also audit procurements below the EU thresholds? Yes. The Federal Audit Office is not limited to the above-threshold area and audits all federal funds, regardless of the contract value.
