Idea Contest in Procurement Law 2026

An idea contest is a design contest for generating creative concepts, without the contracting authority being obliged to award a subsequent contract.

Definition: An idea contest is a special form of design contest under procurement law in which a contracting authority invites creative concepts and design ideas without committing itself to the subsequent award of a contract; it serves to generate ideas and to prepare decisions.

What is an idea contest?

The idea contest is a form of design contest in which the contracting authority – unlike in a realisation contest – is not obliged to award a design contract afterwards. It serves to gather ideas and concepts for a planning problem (e.g. urban development, open-space design, architecture) and to select the best approach. The prize-winning entries do not give rise to any entitlement to a subsequent award.

Distinction from the realisation contest

In a realisation contest the declared objective is to obtain from the contest a design fit for award and to commission the prize-winner with the further planning. In an idea contest the emphasis is on the generation of ideas; there is no obligation to award a contract. Both forms are design contests within the meaning of the procurement directives.

Classification under procurement law

Design contests (idea and realisation contests) are governed by Directive 2014/24/EU (Articles 78–82) and, at national level, by §§ 78–80 VgV and §§ 158–166 BVergG 2018. They are regarded as special procurement procedures subject to specific requirements:

  • An anonymous procedure with concealed submission
  • Evaluation by an independent jury made up of experts
  • The award of prize money or commendations
  • Publication of the contest in TED (where the EU thresholds are reached)

Jury and prize money

An essential feature of the idea contest is the independent jury that evaluates the entries submitted anonymously and selects the prize-winners. A majority of the jury must consist of experts in the same discipline as the participants (§ 80 para. 1 VgV). Prize money must be offered in order to encourage participation.

FAQ

Is the contracting authority obliged to award a contract to the winner of an idea contest? No. In the idea contest there is no obligation to award a contract. The contracting authority may take up the ideas without commissioning the prize-winner.

From what value must an idea contest be advertised throughout the EU? Where the prize money exceeds the EU threshold (currently EUR 143,000 for classic public contracting authorities), EU-wide publication is required.

Who may participate in the idea contest? The contracting authority determines the eligible participants. The contest may be open (anyone may take part) or restricted (only selected participants).
