Needs Assessment in Procurement Law 2026

Needs assessment in public procurement: foundation of every procurement, methods, market research and legal requirements in Austria and Germany.

Definition: A needs assessment is the first and most fundamental step in the public procurement process, in which the contracting authority defines the nature, scope and quality of the service, supply or works needed, before a procurement procedure is launched.

What is a needs assessment?

A needs assessment is the precursor to every procurement procedure and lays the foundation for an economical and legally sound purchase. It answers the fundamental questions: What is needed? In what quantities? At what time? What quality requirements apply? Without a careful needs assessment, errors in the specification, uneconomical procurement and procurement-law violations may follow.

The principle of economy and efficiency (§ 7 BHO / § 6 WHG) requires contracting authorities to undertake a thorough needs analysis before public funds are committed.

Steps of a needs assessment

A structured needs assessment comprises several sequential steps.

1. Needs identification

The specific procurement requirement is identified: What service or product is needed? Is it a one-off or recurring need?

2. Needs specification

The requirement is refined: which technical, qualitative and other requirements must the service meet? Product neutrality must be observed – no commitment to specific brands or manufacturers.

3. Needs quantification

Quantity, scope and duration are determined. For framework agreements, the expected total requirement must be estimated, as this is decisive for threshold calculations.

4. Market exploration

The market is analysed to gather information on available products, technologies, prices and potential providers. Market exploration must not lead to a prior commitment to individual providers.

5. Cost estimate

Based on the needs specification and market exploration, the expected contract value is estimated. This is decisive for the choice of procurement procedure and threshold assessment.

Needs assessment and the specification

The result of the needs assessment feeds directly into the specification, which is the heart of the procurement documents. An incomplete or faulty needs assessment typically leads to an inadequate specification, which in turn causes variation orders, disputes and economic loss.

Needs assessment and climate action

Modern needs assessments must also incorporate aspects of sustainability and climate protection. Contracting authorities are increasingly required, when determining needs, to consider whether more environmentally friendly or lower-emission alternatives are available (e.g. Clean Vehicles Procurement Act, CSR requirements).

FAQ

Can the needs assessment be amended subsequently? Yes, but only until the procurement procedure is launched. During an ongoing procedure, changes to the needs specification are only possible within narrow limits and must be communicated to all tenderers.

What is the difference between needs assessment and market exploration? Needs assessment defines the "what"; market exploration provides information on the "how" and "with what". Market exploration is part of the needs assessment but not identical to it.

May the contracting authority hold discussions with undertakings during the needs assessment? Yes, preliminary market consultations are expressly permitted (Art. 40 Directive 2014/24/EU / § 28 VgV). The information obtained must not result in a competition-distorting advantage for individual tenderers.
