What are pre-qualification competition documents?
Pre-qualification competition documents are the counterpart to the procurement documents of the second stage of the procedure: they fully inform applicants of what they must submit in the pre-qualification competition and according to which criteria they will be selected. These documents are provided in two-stage procurement procedures – the restricted procedure, the negotiated procedure with a notice and the competitive dialogue.
The term is not always used uniformly in German procurement practice; the designations "application documents" or "documents for the pre-qualification competition" are also common.
Typical content
Pre-qualification competition documents usually include the following elements:
- Description of the subject matter of the contract to an extent that enables applicants to assess their suitability and interest
- Suitability requirements (minimum requirements regarding turnover, references, certificates etc.)
- Selection criteria for shortlisting in case of excess applicants
- Standard forms for the request to participate and the European Single Procurement Document (ESPD)
- Deadline information (submission deadline, date of the selection decision)
- Procedural information (submission route, query procedure, language of communication)
Provision and electronic access
Above the EU thresholds, pre-qualification competition documents must in principle be provided electronically and free of charge. Provision takes place via procurement platforms; the link is given in the notice. Applicants have the right to be able to download the documents in full and without registration barriers – although platforms may require simple, non-discriminatory registration.
Answering applicant questions
Applicants may submit questions on the documents during the participation deadline; the contracting authority must answer these to all applicants simultaneously. The answers are usually published as bidder information on the procurement platform so that no applicant gains an information advantage.
