Are retail concessions subject to public procurement law? Services concessions (e.g. for kiosks in government buildings) are subject to the Concessions Directive (2014/23/EU) above a threshold of EUR 5,538,000 and, in Germany, to the KonzVgV. Below the threshold, national procurement principles apply (transparency, equal treatment).

Can public contracting authorities procure retail goods without tendering? Below the value limits (in Germany under UVgO: direct purchase up to EUR 1,000, negotiated procedure up to EUR 25,000), informal procurement is possible. For standardised goods, dynamic purchasing systems or e-catalogue procedures may also be used.
