For whom is NACE 53.1 relevant in public procurement?
Public contracting authorities
Practically every public body is a potential contracting authority for postal services. Particularly high volumes come from tax authorities (bulk dispatch of tax decisions), the judiciary (court service), social insurance providers (decisions, pension notifications) and municipal administrations. In Germany, many federal states and federal authorities pool postal needs in central framework agreements, e.g. through the federal procurement office (BeschA) or Bundesdruckerei.

In addition to the statutory universal service provider, other providers can also participate in tenders in liberalised markets, provided they meet the eligibility criteria:

Must postal services for a public authority always be tendered?
Yes, as soon as the contract value exceeds the relevant threshold. Many authorities underestimate their annual mail volume — a careful estimate is a prerequisite for the correct type of procurement.
May Deutsche Post AG be awarded contracts without tendering?
No — despite its special position as universal service provider, there is no exception to public procurement law. Direct award would only be permissible below the thresholds or where statutory exceptions are met.
What is the difference between NACE 53.1 and NACE 53.2 in procurement?
NACE 53.1 concerns the licensed universal service (e.g. Deutsche Post, Österreichische Post). NACE 53.2 covers commercial courier, express and parcel services without a universal service obligation. In practice, both areas are often tendered in one lot or as a combined package.
Does postal secrecy also apply to tendered services?
Yes. Postal secrecy under Article 10 of the Basic Law and § 39 TKG applies to all postal carriers regardless of the type of procurement. Contractors must contractually guarantee postal secrecy.
