FAQ

Do hotel overnight stays have to be tendered? Hotel services are service contracts. Below the thresholds (EUR 221,000), simplified procedures are sufficient. Central procurement bodies conclude framework agreements with hotel chains or booking platforms that individual authorities can access (e.g. through the Federal Travel Expenses Act and approved booking systems).

Is municipal asylum seeker accommodation subject to public procurement law? Yes. The renting of accommodation from private operators and the award of operating services for shared accommodation are subject to mandatory tendering, provided the thresholds are exceeded. Framework agreements are particularly widespread here to allow response to fluctuating demand.
