Is the award of gambling concessions subject to procurement law? Yes — according to the CJEU's case law, the granting of gambling concessions must be measured against primary law (freedom of establishment, freedom to provide services) and requires a transparent procurement procedure. The Concession Directive 2014/23/EU applies only to a limited extent to gambling concessions.

Can the state maintain its gambling monopoly without tendering? The CJEU has ruled that state gambling monopolies can be compatible with EU law if they are designed coherently and systematically to reduce gambling addiction. The award of system technology and services to third parties must nevertheless be tendered.
