What is an implementing regulation in public procurement?

In European procurement law, the European Commission's implementing regulations play an increasingly important role in harmonising and technically specifying Member States' procurement-law obligations. Unlike directives, which must first be transposed into national law by Member States, regulations — including implementing regulations — apply directly in all Member States without any national transposing act.

Key implementing regulations in procurement law

Several Commission implementing regulations shape the practice of EU procurement law:

eForms Implementing Regulation (EU) 2019/1780

Implementing Regulation (EU) 2019/1780 governs the standardised electronic forms (eForms) for the publication of contract notices in the Supplement to the Official Journal of the EU. Since October 2023, eForms have been mandatory for all EU-wide procurement procedures and have replaced the previous standard forms. They allow machine-readable capture of all notice data and improve statistical analysis of the European procurement market.

CPV Regulation (EC) 213/2008

Implementing Regulation (EC) 213/2008 establishes the CPV codes (Common Procurement Vocabulary) that must be used for the uniform classification of contract subject matter in all EU procurement notices. CPV codes form a standardised classification system that facilitates the discoverability of tenders and enables statistical analysis.

Threshold-value regulations

The EU thresholds are adjusted every two years by Commission implementing regulations to take account of exchange-rate movements and economic developments. The current thresholds are set out in the relevant implementing regulation in force.

Relationship to directives and national law

Implementing regulations supplement procurement directives at a technical level without altering the underlying obligations of the directives. They take precedence over national law in so far as they govern the same subject matter.
