Definition: The Procurement Statistics Ordinance (VergStatVO) is a German ordinance that requires public contracting authorities to report statistical data on awarded public contracts of EUR 25,000 (net) and above to the Federal Statistical Office.

What is the VergStatVO?

The Procurement Statistics Ordinance (VergStatVO) creates the legal basis for comprehensive procurement statistics in Germany, serving both the national transparency interest and the EU reporting obligation under Art. 85 of Directive 2014/24/EU. It was authorised by the 2016 Procurement Law Modernisation Act, issued on 12 April 2016 and entered into force – after a multi-year build-up of the technical infrastructure – on 1 October 2020.

The VergStatVO is an ordinance of the federal government and applies directly to all public contracting authorities within the meaning of the GWB (the federal government, the Länder, municipalities and other public bodies).

Scope

The reporting obligation under the VergStatVO applies to:

  • All public contracting authorities under § 99 GWB
  • Utilities contracting authorities under § 100 GWB
  • Concession grantors under § 101 GWB

Contract value thresholds:

  • Supply and service contracts: from EUR 25,000 (net)
  • Works contracts: from EUR 25,000 (net)
  • Concessions: from EUR 500,000 (net)

Contracts below these thresholds are exempt from the reporting obligation.

Data to be reported

For each contract subject to reporting, the following information must be transmitted:

  • Name of the contracting authority
  • Type of procurement procedure
  • CPV code (subject matter of the contract)
  • Contract value (net)
  • Number of bids received
  • Information on the contractor (name, SME status, seat)
  • Date of contract award
  • For EU-wide procedures: notice number (TED)

Reporting deadlines

The report must be submitted within 60 days of the end of the procurement procedure (contract award or cancellation). For EU-wide procurements for which a contract award notice has already been published in the EU Official Journal, the reporting obligation is automatically fulfilled by taking over the TED data, provided that all required information is included.

Technical implementation

Reporting is carried out electronically via the Procurement Statistics Portal of the Federal Statistical Office (Destatis). Public contracting authorities can:

  • Submit individual reports via an online form
  • Submit reports by file upload (CSV, XML)
  • Use interfaces in their procurement software for automatic transmission

Automatic data transmission via procurement software is the preferred route, as it minimises the manual effort.

Sanctions

The VergStatVO does not contain any direct fines for breach of the reporting obligation. Compliance is monitored by the respective budgetary and audit authorities. Indirectly, breach of the reporting obligation may be regarded as a breach of procurement law.

Relevance for contracting authorities

For most public contracting authorities, the VergStatVO initially represented a new and burdensome administrative duty. The scope of the reporting obligation – in particular the recording of contracts of EUR 25,000 and above in the sub-threshold area – goes considerably beyond the previous EU reporting obligation. Contracting authorities without suitable procurement software must set up corresponding processes.

Recommendations for practice:

  • Integrate the procurement statistics reporting obligation into the procurement process from the outset
  • Use procurement software with a VergStatVO interface
  • Clearly regulate internal responsibility for reporting
  • Record deadlines in the procurement management system

FAQ

Does the VergStatVO also apply to procurement in the sub-threshold area? Yes. The reporting obligation applies from EUR 25,000 net, regardless of whether the contract is above or below the EU thresholds. This was a significant extension compared with previous practice.

What happens if a procurement procedure is cancelled? Cancelled procurement procedures are also subject to reporting if they exceed the contract value threshold. The report must then also contain the reasons for cancellation.

Must framework agreements be reported? Yes. Framework agreements must be reported at the time of conclusion. Individual calls under framework agreements are also subject to reporting if they exceed the value threshold.
