What is the tender result?
The tender result comprises all information that must be communicated to tenderers and the public after a procurement procedure has been concluded, in order to ensure transparency about the award decision. It consists of two components: the internal tenderer information (award decision) and the public contract award notice.
Tenderer information (award decision)
All tenderers who participated in the procedure must be informed of the proposed award decision before the contract is concluded. The information must be detailed enough to allow unsuccessful tenderers to assess whether their rights have been infringed. Mandatory contents of the tenderer information:
- Name of the proposed successful tenderer
- Total score or overall evaluation of the tenderer's own offer
- Total score or overall evaluation of the highest-ranked offer
- Characteristics and advantages of the successful offer
- In Germany: reasons for rejection of the tenderer's own offer
Contract award notice (TED)
In EU-wide procurement, the contracting authority must publish a contract award notice on TED no later than 30 days after contract conclusion. This public notice contains, among other things: the contractor's name, the total contract value, the procedure type and the essential contract conditions.
Significance for tenderers
The tender result is the basis on which tenderers decide whether to challenge the award decision in review proceedings. The standstill period begins with notification of the award decision. Tenderers typically have 10–15 days to file a review application.
FAQ
Is a tenderer entitled to inspect other tenders? No. Other tenderers' offers are protected by trade secrecy. Information is shared only to the extent necessary for the exercise of review rights.
What is a contract award notice? The contract award notice is the post-conclusion publication on TED reporting the outcome of the procurement procedure. It must be distinguished from the tenderer information (issued before contract conclusion).
